National Labor Relations Board-NJ PERC Update
Join us for the final meeting of the 2025-26 year as the Deputy General Counsel of the PERC and NLRB Newark Regional Director discuss recent developments at their respective Agencies. The NLRB now has three of five members, with a 2-1 Republican majority. The Regional Director and our panel of practitioners will address legal developments, including the joint employer doctrine, organizing in the cannabis sector, and adjustments to its Cemex election procedures decision. We will also discuss the recent decision of the NJ State Supreme Courtin Rutgers v. AFSCME, where the Court found a contractual grievance procedure preempted by federal Title IX regulations, the Workplace Democracy Enhancement Act, the Responsible Collective Negotiations Act, recent changes to PERC’s unfair practice and representation rules, highlight developments in Interest Arbitration from the recent Paterson decision and pending legislative reforms.
